The decision to reject activists’ lawsuit means developer Mike Harrah has cleared the final legal hurdle to build a 37-story tower in Santa Ana.
The 4th District Court of Appeal rules that construction of the
37-story office tower in Santa Ana may go forward.
Members of a residents group opposed to the city’s One Broadway
Plaza project say the developer should have paid for a special
election in which voters approved the project. Harrah says no
way.
The decision is hailed as a victory by a group of Santa Ana
residents that has been fighting development of the 37-story
tower.
More arguments heard last week in case over the building of what
would be county’s tallest tower, but it could be weeks, or even
months before ruling.
Superior Court Judge denied Santa Ana’s request to dismiss the
lawsuit and said there might be a “novel legal question” to be
answered.
