Yorba Linda Water District Board & Staff Served Writ of Mandate from YLTA

Members of the Yorba Linda Water District (YLWD) Board of Directors, their legal counsel Art Kidman and General Manager Marc Marcantonio were served a Writ of Mandate from the Yorba Linda Taxpayers Association at their Thursday morning meeting of January 14. In attendance were YLTA members Kent Ebinger and Jon Hansen. Watch the video at this link: https://www.youtube.com/watch?v=tRlYBc5oFfU

The Writ is a legal petition to Orange County Superior Court that asks a judge to order the Water Board to follow the law and either rescind the water rates they approved on September 17, 2015 or place the water rate referendum on the ballot for voters to decide. To read the full Writ of Mandate, you can download all the documents at this link: https://app.box.com/s/vqlrs3nqv8fgpq1vqg5aj9lvxeei6zyu

YLTA obtained over 5500 signatures (twice the amount required by law) on a referendum petition in late September and early October that was addressed by the Water Board at a special meeting on November 5. The Board took no action on the referendum petition, claiming it was illegal based on a report from their counsel Art Kidman that cited no law or case law to substantiate his claims.

For more information contact Ed Rakochy at (714)381-2395 or edrakochy@me.com. Chairman Jeff Decker is on assignment in China and will return January 22.
